Terms and Conditions
The main terms for using Neon Motive and ordering a custom-made sign.
These Terms govern the use of the Neon Motive website and the purchase of custom-made LED neon signs, Infinity Mirror signs and related accessories.
1.1 About us
Neon Motive is a trading name of Dynamic Marketing Investments (registration number 2014/288722/07), the legal seller. Our business address is 43 Hyacinth Close, Corporate Park, Magnavia, Polokwane, Limpopo, 0699, South Africa. Our products are designed to the customer’s selected specifications and are custom-manufactured by approved production partners. Unless a product page expressly states otherwise, the current manufacturing origin is China. We do not claim that products are manufactured locally in the customer’s country.
1.2 Acceptance of these Terms
By using the website, creating an account, submitting a design, approving a proof or placing an order, you agree to these Terms and the policies incorporated into them. If you do not agree, do not place an order.
You must be legally capable of entering into a contract. If you are under the age of majority in your country, a parent or legal guardian must place the order.
1.3 Product information and visual previews
We aim to describe products accurately. Digital previews, room mock-ups, colour swatches and size comparisons are visual guides. Screen settings, wall colour, ambient light, manufacturing tolerances and the physical glow of LED neon may cause the delivered product to look slightly different from an on-screen preview.
The approved production proof, written specifications and order summary form the final design specification. We will not make a material change to the approved design without the customer’s agreement.
1.4 Orders and contract formation
Submitting an order is an offer to purchase. An automated acknowledgement confirms that we received the order but does not necessarily mean that we accepted it. We may reject or cancel an order before production if the design cannot be manufactured safely, infringes third-party rights, contains prohibited content, is incorrectly priced because of a clear system error, or cannot be delivered to the stated destination.
If we cancel an order before production for a reason not caused by the customer, we will refund the amount paid for the cancelled item.
1.5 Accounts
You are responsible for keeping your login details secure and for activity carried out through your account. Tell us promptly if you believe that your account has been accessed without permission. We may suspend an account where reasonably necessary to protect customers, the business or the website.
1.6 Prohibited use
- Do not upload unlawful, infringing, hateful, defamatory, abusive or deceptive content.
- Do not attempt to interfere with website security, pricing, payment processing or other customers’ accounts.
- Do not scrape, reproduce or commercially exploit the website, builder or content without permission.
- Do not submit an order using payment information or artwork that you are not authorised to use.
1.7 Mandatory consumer rights
Nothing in these Terms excludes, restricts or replaces rights that cannot lawfully be excluded in the customer’s country. If a provision conflicts with a mandatory consumer protection law, that mandatory law prevails to the extent of the conflict.
1.8 Liability
To the maximum extent permitted by law, we are not responsible for indirect, incidental or consequential loss that was not reasonably foreseeable when the contract was formed. We do not exclude liability where doing so would be unlawful, including liability for fraud, wilful misconduct, death or personal injury caused by negligence, or mandatory product and consumer guarantees.
Customers are responsible for safe installation, suitable wall support, correct electrical use and following the supplied instructions. Professional installation may be appropriate for large, elevated, commercial or outdoor signs.
1.9 Governing law
These Terms and the contract are governed by the laws of South Africa. The courts of South Africa have jurisdiction, but this choice does not deprive a consumer of mandatory protections or access to a competent court that applies in the country where the consumer lives.
